Introduction

PRO ATHLETE inc., a Quebec corporation ("we", "us", "our"), is committed to protecting your privacy. This Privacy Policy outlines how we collect, use, disclose, and safeguard your personal information collected on www.proathlete.ca and the PRO ATHLETE mobile and web applications in compliance with Quebec’s Loi 25, as well as international data protection laws.

This Privacy Policy describes the information that PRO ATHLETE collects (directly or indirectly) and why we collect it, what we do with the information we collect and how you can manage your Personal Data (defined below).

Information We Collect

Personal Information

Contact details including name, email, telephone number and shipping, billing address;
Personal details including gender, hometown, date of birth and purchase history, login and account information, including screen name, password and unique username;
Health and injury information (only for research and personalization purposes)

Usage Data

App activity logs: dates and time of log-ins, activity and program completion, exercise completion
Program progression and completion
Feedback and user-generated content

When interacting with our website and apps, data may automatically be collected and shared with PRO ATHLETE by the technology platforms providing the experience. For example, your web browser or mobile device may share certain data with PRO ATHLETE as those devices interact with PRO ATHLETE’s sites or apps. More information about these practices is included in the Cookies and Pixel Tags section below. This data may include: Device IDs, call state, network access, storage information and battery information, Cookies, IP addresses, referrer headers, data identifying your web browser and version, and web beacons and tags.

In many cases, your web browser or mobile device platform will provide additional tools to allow you to control when your device collects or shares particular categories of information. For example, your mobile device or web browser may offer tools to allow you to manage cookie usage or location sharing. We encourage you to familiarize yourself with and use the tools available on your devices

How We Use Your Information

We use the collected data for the following purposes:

To personalize training, mobility, prehab, and warm-up programs proposed in the PRO ATHLETE app
To enhance user experience and app functionalities.
To conduct general research and research on the effectiveness of our programs in preventing injuries and improving performance.
To communicate with you about updates, promotions, and relevant information about PRO ATHLETE.
To operate, improve and maintain our business, products and services
To protect our or others' rights, property or safety
Other purposes: We may also use your personal data in other ways and will provide specific notice at the time of collection and obtain your consent where necessary

Sharing Your Information

With Your Coach: If you are an athlete part of a team, your general activity and progression data will be shared with your coach for the duration of your subscription. Information about injuries will not be shared with other users, including your coach.
With a Health Professional: If you are an athlete and working directly with a health professional with the PRO ATHLETE app, your data may be shared with the Health Professional to ensure to enhance app experience and personalize exercise prescription.
Service Providers: We may share your information with third-party service providers to facilitate our services, such as data storage and analysis and payment solutions. These providers are bound by strict confidentiality agreements.
Legal Obligations: We may disclose your information if required by law, or to protect our rights, privacy, safety, or property, and/or that of you or others.

PRO ATHLETE shares your personal data with PRO ATHLETE subsidiaries and other affiliated entities for the purposes and under the conditions outlined above, with Third party service providers processing personal data on PRO ATHLETE’s behalf (for example to process credit cards and payments, shipping and deliveries, manage and service our data, distribute emails, research and analysis, manage brand and product promotions as well as administering certain services and features) and other third parties to the extent necessary to: (i) comply with a government request, a court order or applicable law; (ii) prevent illegal uses of our Sites and Apps or violations of our Sites’ and the Apps’ Terms of Use and our policies; (iii) defend ourselves against third party claims; and (iv) assist in fraud prevention or investigation (e.g., counterfeiting)

We may also transfer personal data we have about you in the event we sell or transfer all or a portion of our business or assets (including in the event of a reorganization, spin-off, dissolution or liquidation).

Children's Privacy

We collect personal information from users of all ages. IF YOU ARE 16 AND YOUNGER, YOU CONFIRM THAT YOU HAVE RECEIVED PARENTAL OR LEGAL GUARDIAN CONSENT FOR DATA COLLECTION AND PROCESSING BY USING THE PRO ATHLETE APPS AND WEBSITES.

Data Storage and Security

We use a variety of technical and organizational security measures to maintain the safety of your personal data. Your personal data is contained behind secured networks. The personal data we collect or generate (process) in the context of our Sites and Apps are stored in the Google Data Centre in Lachine, Quebec, Canada. Some of the data recipients with whom PRO ATHLETE shares your personal data may be located in countries other than the country in which your personal data originally was collected. The laws in those countries may not provide the same level of data protection compared to the country in which you initially provided your data.

We retain your personal data for as long as necessary to fulfil the purposes for which we collect it. Therefore, PRO ATHLETE may retain your data even after you have deleted your account if such retention is reasonably necessary to (i) conform to applicable law, (ii) resolve a conflict, (iii) prevent fraud, abuse or any infraction to the law, (iv) to enforce this Privacy Policy. Furthermore, PRO ATHLETE may retain your personal data as long as it may be necessary in order to address any demand, to communicate with you or to generate analysis of tendencies.

Your Rights

You have the right to request: (i) access to your personal data; (ii) correction of your personal data if it is incomplete or inaccurate; or (iii) deletion of your personal data. Where we have obtained your consent for the processing of your personal data, you have the right to withdraw your consent at any time. You also have the right to object to the processing of your personal data, including opting-out from the use for direct marketing purposes.

Cookies and pixel tags

PRO ATHLETE receives and records information, which may include personal data, from your browser when you use our Sites. We use a variety of methods, such as cookies and pixel tags to collect this information, which may include your (i) IP-address; (ii) unique cookie identifier, cookie information and information on whether your device has software to access certain features; (iii) unique device identifier and device type; (iv) domain, browser type and language, (v) operating system and system settings; (vi) country and time zone; (vii) previously visited websites; (viii) information about your interaction with our Sites such as click behavior, purchases and indicated preferences; and (ix) access times and referring URLs.

We use cookies and pixel tags to track our customers’ usage of the Sites and to understand our customers’ preferences (such as country and language choices). This enables us to provide services to our customers and improve their online experience. We also use cookies and pixel tags to obtain aggregate data about site traffic and site interaction, to identify trends and obtain statistics so that we can improve our Sites. If you turn cookies off, you may not have access to many features that make our Sites and Apps more efficient and some of our services will not function properly.

Tools we use

HighLevel: sending our emails and newsletters, sign-ups for our free resources and access to our online courses.
Google Analytics: measuring traffic and use of our website (pages viewed, clicks, where visits come from).
Microsoft Clarity: analyzing how visitors navigate our website (clicks, scrolling and session recordings) to improve its usability.

These providers may process data outside Quebec and Canada, including in the United States. You can unsubscribe from our emails at any time using the unsubscribe link included in every message.

Using PRO ATHLETE sites and apps with third-party products and services

Our Sites and Apps allow you to interact with a wide variety of other digital products and services. For example, our Sites and Apps can integrate with third-party devices for activity tracking, social networks, music streaming services and other digital services.

If you choose to connect your PRO ATHLETE account with a third-party device or account, your privacy rights on third-party platforms will be governed by their respective policies. For example, if you choose to share your PRO ATHLETE activity on third-party social media platforms, the policies of those platforms govern the data that resides there.

Our Sites and Apps may provide links to other (third-party) websites and apps for your convenience or information. Linked sites and apps have their own privacy notices or policies, which we strongly encourage you to review. To the extent any linked websites or apps are not owned or controlled by us, we are not responsible for their content, any use of the websites or apps, or the privacy practices of the websites or apps.
